These Terms and Conditions (“Terms”) govern your access to and use of the Fourth Official platform, available at fourthofficial.ai, operated by Fourth Official Analytics FZ-LLC, a company registered in Ras Al Khaimah Economic Zone (RAKEZ), United Arab Emirates (“Fourth Official”, “we”, “us”, or “our”).

By creating an account or using the platform, you agree to be bound by these Terms. If you do not agree, you must not access or use the platform.

1. About the Platform

Fourth Official is a sports analytics, media, and entertainment platform. We provide football statistics, data-driven visualizations, historical insights, and analytical content designed strictly to enhance your experience of watching and following football.

1.1 Entertainment and Informational Purpose Only

All content, insights, statistics, and analytical outputs provided on the platform are for entertainment and informational purposes only. They are intended solely to enrich your enjoyment and understanding of football as a sport.

Our models are built entirely on the historical and on-pitch sporting fundamentals of football (e.g., team performance metrics, player statistics, and tactical data). They represent probabilistic statistical assessments. Football is inherently unpredictable, and our data visualizations are not guarantees of any future real-world outcome. We do not provide financial forecasting, real-money gaming integrations, or any related features.

4. Subscription Plans and Payment

4.1 Free and Premium Tiers

The platform offers a free tier with access to a limited set of features. Premium features are available through a paid subscription (“Premium”). Premium subscriptions are available on weekly and monthly billing cycles.

4.2 Billing

By subscribing to Premium, you authorise us to charge the applicable subscription fee at the start of each billing cycle. Fees are charged in advance and are displayed clearly before you confirm your subscription.

4.3 No Refunds

All subscription payments are non-refundable. We do not offer refunds, credits, or pro-rata reimbursements for any subscription period, whether used in full or in part.

4.4 Cancellation

You may cancel your Premium subscription at any time through your account settings. Upon cancellation, your subscription will remain active until the end of the current billing period. After that, your account will revert to the free tier. No further charges will be made following cancellation.

4.5 Price Changes

We reserve the right to change subscription pricing at any time. Any price changes will be communicated to existing subscribers in advance and will take effect at the start of the next billing cycle following the notice period.

5. Acceptable Use

You agree not to:

• Use the platform for any unlawful purpose.
• Attempt to gain unauthorised access to any part of the platform, its systems, or its data.
• Scrape, crawl, or use automated tools to extract data from the platform without our prior written consent.
• Reproduce, distribute, or commercially exploit any content from the platform without our prior written consent.
• Use the platform to promote real-money gaming, financial forecasting, or related products.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Upload or transmit any content that is harmful, threatening, abusive, defamatory, or otherwise objectionable.
• Interfere with or disrupt the integrity or performance of the platform.

6. Data Usage, Scraping, and Commercial Exploitation

As a data-driven platform, the integrity, security, and exclusive licensing of our underlying statistics and AI models are vital to our business.

6.1 Prohibition on Scraping and Automated Extraction

You are strictly prohibited from using any automated systems, software, or tools to extract, harvest, scrape, or spider data, content, or insights from the platform.

6.2 No Commercial Resale or Syndication

Your Premium subscription grants you a licence for personal, non-commercial use only. You may not sell, lease, rent, sub-licence, or commercially distribute any data, predictions, or visualizations obtained from Fourth Official.

6.3 Database Creation and AI Training

You may not systematically download or store our data to create, populate, or maintain your own independent database. You are strictly prohibited from using any data, text, or visual outputs from Fourth Official to train, fine-tune, or develop any machine learning models, artificial intelligence systems, or large language models.

6.4 Third-Party Data Provider Rights

Certain statistical data and historical records provided on our platform are supplied under licence from third-party data providers. Any unauthorized extraction, reproduction, or commercial use of this data constitutes a direct breach of these Terms.

6.5 Enforcement and Liquidated Damages

We actively monitor the platform for scraping and unauthorized commercial usage. If we detect automated extraction or commercial exploitation tied to your account, we will terminate your access immediately without refund.

7. Intellectual Property

7.1 Our Content

All content on the platform — including but not limited to text, graphics, logos, icons, data, statistical models, insights, software, and design — is the property of Fourth Official Analytics FZ-LLC or its licensors and is protected by applicable intellectual property laws.

7.2 Limited Licence

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the platform for your personal, non-commercial use in accordance with these Terms.

7.3 Restrictions

You may not copy, modify, distribute, sell, lease, or create derivative works based on any content from the platform without our prior written consent.

8. Data and Privacy

Your use of the platform is also governed by our Privacy Policy and Cookie Policy, which describe how we collect, use, and protect your personal data. We store and process data within the European Union.

9. Disclaimers

9.1 No Warranties

The platform is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied.

9.2 Accuracy of Content

9.3 Availability

10. Limitation of Liability

To the maximum extent permitted by applicable law, Fourth Official, its directors, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform. Our total aggregate liability shall not exceed the total amount you have paid to us in the twelve (12) months immediately preceding the event giving rise to the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Fourth Official Analytics FZ-LLC, its directors, officers, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the platform or your breach of these Terms.

12. Modifications to the Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via the platform or by email. Your continued use of the platform after such changes constitutes acceptance of the revised Terms.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates as applied in the Emirate of Ras Al Khaimah. Any disputes shall be subject to the exclusive jurisdiction of the RAKEZ arbitration framework or the competent courts of Ras Al Khaimah, UAE.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Fourth Official regarding your use of the platform and supersede any prior agreements.
